Ride351 is a trading brand of QueluzTur – Agência de Viagens e Turismo, Lda – UNIPESSOAL, a company registered in Portugal.
All bookings and travel contracts are concluded exclusively with QueluzTur.

  1. Bookings, Payments and Special Ride351 Conditions

2.1 General Booking Conditions

All reservations are subject to confirmation by suppliers of the services included. QueluzTur reserves the right to cancel any booking for which payment has not been made in accordance with the conditions below.

2.2 Ride351 Payment Conditions (Prevailing Conditions)

The following payment conditions apply specifically to tours and travel packages marketed under the Ride351 brand and prevail over any other general payment terms.

  1. a) Day Tours
  • All day tour bookings require 100% advance payment at the time of booking.
  1. b) Multi-Day Tours and Travel Packages
  • A 30% deposit of the total price is required to confirm the booking.
  • The remaining 70% balance must be paid no later than 30 days prior to the arrival date.

Failure to meet these deadlines may result in cancellation of the booking by the agency.

  1. Alternative Dispute Resolution

In accordance with Law no. 144/2015 of 8 September, the Traveller may resort to the following Alternative Dispute Resolution entity:

  1. Complaints

Any lack of conformity in the performance of travel services included in the organized travel contract must be communicated without undue delay to the organizing or retail travel agency, in accordance with Article 28(1) of Decree-Law no. 17/2018.

The right to submit complaints for price reduction or compensation expires two (2) years after the date of the service, pursuant to Article 28(5) of the same Decree-Law.

  1. Baggage

The agency is responsible for the Traveller’s baggage under applicable law.
The Traveller must immediately report loss, damage, or destruction of baggage to the service provider.

For international transport:

  • Claims for damaged baggage must be submitted in writing within 7 days of delivery.
  • Claims for delayed baggage must be submitted within 21 days of delivery.

Failure to submit such claims may prevent QueluzTur from exercising its right of recourse against the service provider.

  1. Limits of Liability

The agency’s liability is limited to the maximum amounts provided for in:

  • The Montreal Convention (1999) for international air transport;
  • The Berne Convention (1961) for rail transport.

For maritime transport, liability limits under Article 36(2) of Decree-Law no. 17/2018 are:

  • €441,436 for death or personal injury
  • €7,881 for baggage loss or damage
  • €31,424 for loss of a motor vehicle (including baggage)
  • €10,375 for baggage contained in a motor vehicle
  • €1,097 for baggage damage resulting from vehicle damage

For accommodation establishments, liability limits under Article 36(3) are:

  • €1,397 total
  • €449 per item
  • Declared value for items deposited for safekeeping

Liability for non-bodily damages is contractually limited to three times the price of the travel service sold.

  1. Travel Documentation

The Traveller is responsible for holding all required documentation, including:

  • Citizen Card or Passport
  • Visa (when required)
  • Authorization for minors (when required)
  • Vaccination certificates (when required)

The agency is not responsible for visa refusals or denial of entry into a country. Any resulting costs are borne by the Traveller.

European Union Travel

Travellers must carry valid identification documents. For medical assistance, the European Health Insurance Card is required.

Travel Outside the European Union

Travellers must hold a valid passport and visa if required. Non-EU nationals must consult their embassies or consulates.

  1. Booking and Amendment Fees
  • Booking fee: €20.00 per reservation
  • Amendment fee: €30.00 per change (names, dates, accommodation type, itinerary, etc.)

All changes are subject to supplier approval.

  1. Traveller-Requested Changes

If permitted by suppliers, the Traveller may request changes subject to applicable amendment fees.

Requests made 21 days or less before departure, or not accepted by suppliers, are subject to the cancellation conditions set out below.

After departure, any requested changes not attributable to the agency may result in prices differing from those originally published.

  1. Changes by the Agency

Before departure, if the agency:

  • Significantly alters essential travel characteristics;
  • Cannot meet special requirements;
  • Proposes a price increase exceeding 8%;

The Traveller may:
a) Accept the proposed change;
b) Cancel the contract without penalty and receive a refund;
c) Accept a replacement travel package.

Failure to respond within the given deadline constitutes tacit acceptance.

  1. Transfer of Booking

The Traveller may transfer the travel contract to another person who meets all requirements, provided written notice is given at least 7 days before departure.

The original and substitute Travellers are jointly liable for outstanding balances and transfer-related costs.

  1. Cancellation by the Agency

The agency may cancel the travel if the minimum number of participants is not reached, with notice given:

  • 20 days before travel longer than 6 days
  • 7 days before travel of 2–6 days
  • 48 hours before travel under 2 days

Cancellation due to unavoidable and extraordinary circumstances entitles the Traveller to a full refund within 14 days.

  1. Ride351 Cancellation Conditions (After Reservation)

For multi-day tours marketed under the Ride351 brand, the following cancellation conditions apply and prevail over general cancellation rules:

  • Up to 21 days prior to start date:
    100% of the deposit refunded, minus bank commissions and service fees.
  • From the 20th to the 15th day prior to start date:
    50% of the deposit charged, plus bank commissions and service fees.
  • From the 14th to the 8th day prior to start date:
    80% of the deposit charged, plus bank commissions and service fees.
  • 7 days or less prior to start date:
    No refund will be made.

For day tours:

  • Up to 8 days prior to start date:
    100% of the deposit refunded, minus bank commissions and service fees.
  • From the 7th to the 3th day prior to start date:
    50% of the deposit charged, plus bank commissions and service fees.
  • 2 days or less prior to start date:
    No refund will be made.
  1. Refunds

After the start of the trip, no refunds are due for unused services, except where refunded by suppliers.

If contracted services are not provided due to causes attributable to the agency and cannot be replaced by equivalent services, the Traveller is entitled to a refund of the price difference.

  1. Price Changes

Prices may be adjusted up to 20 days before departure due to changes in transport costs, fuel, taxes, or exchange rates.

Increases exceeding 8% entitle the Traveller to cancel.
Price reductions may be subject to deduction of justified administrative costs.

 

  1. Traveller Assistance

In case of difficulty, the agency will provide assistance, including:

  • Information on health services, local authorities, and consular assistance;
  • Help with communications and alternative travel arrangements.

Costs may be charged if difficulties arise from Traveller negligence.
Accommodation assistance is limited to three nights, except for vulnerable Travellers.

  1. Agency Responsibility

The agency is responsible for proper performance of travel services, even when provided by third parties, without prejudice to rights of recourse.

The agency is not responsible for errors attributable to the Traveller or unavoidable and extraordinary circumstances.

  1. Insolvency Protection

In case of insolvency, the Traveller may activate the Travel and Tourism Guarantee Fund via:

  1. Insurance

The agency holds civil liability insurance with Ageas, policy no. 8410204081, for €75,000.00.
Optional travel insurance is available and strongly recommended.

Subject to the insurance provider’s terms, travel insurance may allow 100% reimbursement up to arrival and during the trip. The agency is not responsible for reimbursements covered by insurance policies.

  1. Taxes

All prices include VAT at the applicable rate of 23%.

 

  1. Program Validity

This program is valid from 19 March 2024 to 31 December 2026.

 

  1. Standard Information for Package Travel Contracts

The proposed combination of travel services constitutes a package travel within the meaning of Decree-Law no. 17/2018.

Travellers benefit from all EU rights applicable to package travel, including insolvency protection, assistance, refunds, and compensation as provided by law.
